4. Response to DMCA Notices
Upon receiving a valid DMCA takedown notice, the Grid will take the following actions:
Promptly remove or disable access to the allegedly infringing material.
Notify the alleged infringer of the takedown and provide them with a copy of the DMCA notice.
Counter Notification: If the alleged infringer believes their content was wrongly removed, they may submit a counter-notification to the Copyright Agent. The counter-notification should include:
A physical or electronic signature of the alleged infringer.
Identification of the removed material and its location.
A statement, under penalty of perjury, that the alleged infringer has a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
Contact information (name, address, phone number, and email address) of the alleged infringer.
Consent to jurisdiction in the federal district where the alleged infringer resides or has a place of business.
5. Repeat Infringers
The Grid reserves the right to terminate the accounts of users who are repeat infringers of copyright.
6. Counter-Notification Process
Upon receipt of a valid counter-notification, the Grid may:
Restore the removed material.
Notify the copyright owner of the counter-notification.
Replace the removed material within ten (10) business days unless the copyright owner files a lawsuit seeking an injunction against the alleged infringer.
